ACP MAGAZINES My Wii Story Competition

  1. Instructions on how to enter and prizes form part of these conditions of entry. Participation in this promotion is deemed acceptance of these conditions of entry.
  2. Entry is open to residents of Australia who are aged 18 years of age and over only. Employees of the Promoter and their immediate families and agencies associated with this promotion are not eligible to enter. Only one entry per person will be permitted
  3. The promotion starts on June 1, 2009 and closes at 11:59pm, July 21, 2009. The judging will take place at the Promoter’s premises and will begin on 22/07/09. The winner will be notified by phone and mail using contact details provided in their entry. This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit and originality.
  4. To enter, individuals must visit www.mywiistory.com.au during the promotional period and upload a recent photo of themselves and provide their name, address, daytime telephone number and tell us (in no more than 500 words) "Why you love your Wii?"
  5. The judges' decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.
  6. The best four entries as determined by the Promtoer will each receive a trip to Sydney to participate in a Wii photo shoot. Each prize includes a same day return flight from the winners nearest capital city to Sydney (valued at up to $[insert value of most expensive domestic flight to Sydney] (depending on point of departure. Once in Sydney, the 4 winners will each attend a special photo shoot. Photo shoot will take place at a location to be nominated by the Promoter in its complete discretion. The winner’s images (as shot by ACP Magazines) will appear either in a feature appearing in The Australian Women’s Weekly, Madison and Cosmopolitan magazines or a combination of all titles). If the winner is a resident of Sydney/NSW – the flight component of the prize will not be included. Inclusion of any feature and/or image of the winner (including but not limited to creative control) in any ACP Magazines title will be determined by the Promoter in its complete discretion. No correspondence will be entered into.

    The next best 200 entries as determined by the judges will each receive The Australian Women’s Weekly A4 standard size cookbook – "New Entertaining."

  8. Prizes do not include any ancillary costs associated with redeeming the prize. These are the responsibility of the winner. The prize is not transferable, exchangeable or redeemable for cash or other goods and services.
  9. The major prize must be redeemed on the shoot date stipulated by ACP Magazine and will be on any one day during week 3rd till 7th August 2009. It is a condition of accepting the major prize that the winner may be required to sign a legal release document in a form to be determined at the complete discretion of the Promoter. Winners will be notified by mail using contact details provided in their entry.
  10. The prize is non transferable or exchangeable and not redeemable for cash. All aspects of the prize must be taken together as a package.
  11. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. All taxes (excluding GST) which may be payable as a consequence of receiving the prize(s) are the sole responsibility of the winner.
  12. Entries not completed in accordance with the rules and conditions or received after the closing date will not be considered. Indecipherable or incomplete entries will be deemed invalid.
  13. Prize valued in Australian dollars. Prize values are the recommended retail value as provided by the supplier and are correct at time of printing. The Promoter accepts no responsibility for any variation in the value of the prize. Where prize is awarded in the form of a voucher/letter/ticket or pass, the Promoter shall not be liable for any voucher/letter/ticket or pass that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of voucher/letters/ticket/pass is subject to terms and conditions stipulated on voucher/letter/ticket/pass.
  14. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these conditions of entry; (e) any tax liability incurred by a winner or entrant; and/or (f) participation in the prize.
  15. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right (subject to reference to all relevant state and territory regulations) to cancel, terminate, modify or suspend the promotion.
  16. If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law, to (a) disqualify any entrant; and/or (b) subject to any written direction given by a regulatory authority, to modify, suspend, cancel or terminate the promotion, as appropriate. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries. By entering the promotion, the entrant consents to receipt of any email regarding the promotion, from the Promoter and other emails which inform the entrant of the Promoters other publications, products, services and events and to promote third party goods and services it may be interested in.
  17. All entries become the property of the promoter. All entries (including photos) submitted become the property of the promoter. Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant agrees to assign all of their rights, title and interest in and to their entry to the promoter. Each entrant warrants to the Promoter that each entry submitted is a photo of the entrant which does not infringe the rights of any third party. The entrant agrees to indemnify the promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition. The promoter is entitled to use any of the entries submitted for any purposes at its discretion, including for any future promotion, marketing and publicity purposes.

By entering the promotion, the entrant consents to receipt of any email regarding the promotion from the Promoter and other emails which inform the entrant of the Promoter’s other publications, products, services and events and to promote third party goods and services it may be interested in.
